Kathleen Harris Quoted in Global Investigations Review on UK’s First Alleged DPA Breach
Kathleen Harris, head of the firm’s London office and former Head of Policy at the UK Serious Fraud Office (SFO), was quoted in the Global Investigations Review article, “First alleged DPA breach tests UK’s corporate settlement regime.” The article covers the SFO’s first enforcement action for an alleged settlement breach since deferred prosecution agreements (DPAs) were introduced in the UK.
Harris flagged the risks companies face when entering into DPAs prematurely and noted that all businesses should examine the evidence against them closely before rushing into a settlement. “I think the danger is where people enter into these agreements too early to potentially limit the commercial damage that may well ensue,” she said. “But in doing that, when someone challenges or reviews the evidence, it may well be that they find the evidence upon which you entered [the agreement] isn’t reliable.”
