Stacey Halliday Quoted in Bloomberg Law on Trump Administration’s Deregulatory Push
Stacey Halliday, Environmental counsel and former attorney at the U.S. Environmental Protection Agency (EPA), was quoted in the Bloomberg Law article, “Trump’s Deregulatory Moon Shot Stretches Rulemaking Authority,” which explores the administration’s proposal to fast-track regulation repeal by bypassing standard Administrative Procedure Act procedures.
Halliday noted that while the administration aims to expediate deregulation by bypassing standard notice-and-comment procedures, there are more traditional options for agencies seeking immediate relief. She pointed to examples like the EPA’s use of interim final rules (IFRs) as a mechanism for meeting federal requirements for collecting public feedback during the rulemaking process. “The cost-benefit analysis of taking the route that the administration outlines doesn’t completely make sense,” she said, highlighting how use of IFRs could reduce the legal challenges that seeking full exception to notice-and-comment procedural requirements will likely face.
