Kaye Scholer Represents Pfizer in Another Viagra Win
Kaye Scholer's motion for summary judgment was granted in a case of alleged hemorrhagic stroke following ingestion of Viagra. In response to our summary judgment motion, plaintiff acknowledged that there was no science supporting his case, and that it was at most "speculative." Instead, plaintiff relied on the theory of res ipsa loquitor, which was rejected by the judge. The successful Kaye Scholer team included Lori Leskin and Mark Spatz. Invaluable assistance was provided by Steve Glickstein, Bert Slonim, Todd Porter, Walter Lewis and Caren Gurwitz. This decision is the latest in a long line of summary judgment decisions that the Viagra team has obtained over the past decade. They have successfully defended Viagra against claims of heart attack, stroke, vision loss, priapism and other assorted diseases.
