"Invitations to Collude and the FTC's U-Haul Case," The Antitrust Counselor

Claudia Higgins, Partner in the Litigation Department, authored the article “Invitations to Collude and the FTC’s U-Haul Case” in the June 2010 edition of The Antitrust Counselor. The article provides a summary of the FTC’s recent U-Haul case where the FTC took action against U-Haul based in part on comments made by U-Haul’s CEO in a public earnings call. The article explains, among other things, the antitrust risks that can arise from public statements that the antitrust agencies can allege constitute an invitation to collude.
