Fiduciary Litigation/Tax Controversy
We frequently represent both corporate and individual clients on a cross-section of fiduciary litigation and tax controversy matters.
Our fiduciary litigation expertise includes representing parties on the various sides of complicated trust and estate litigation, providing expert guidance in all aspects of fiduciary conflict resolution. Our team advises both corporate and individual clients on a wide range of matters, including will and trust contests, petitions for construction of a will or trust and/or petitions for instruction, claims against estates, marshalling of assets and preparation of an estate asset inventory, preparation of an estate tax return, and litigation involving claims of undue influence, incapacity, or fraud. We also handle estate and trust accounting disputes and complex family disagreements, particularly those involving jointly owned illiquid assets, real estate holdings, and valuable collections such as art and antiques.
Our fiduciary litigation expertise extends to fiduciary matters, including representing both individual and corporate clients in cases involving claims of breaches of fiduciary duty, mismanagement, and contested estate or trust administration. We also advise on disputes related to the distribution of assets, beneficiary rights, and trustee responsibilities, helping to navigate the often complex and emotionally charged nature of family disputes.
Our tax controversy expertise includes assisting corporations, partnerships, and individuals in Internal Revenue Service (IRS) examinations/audits and proceedings before the IRS Independent Office of Appeals, as well as state taxing authorities. We have experience litigating complex tax disputes in the U.S. Tax Court and state and federal trial and appellate courts. Our team has experience assisting individual and corporate clients on a wide range of tax disputes, including those related to estate taxes, gift taxes, valuations, employment taxes, worker classifications, information reporting with respect to foreign corporations or foreign assets, failure to pay/failure to file penalties, and all other types of civil penalties, as well as criminal tax matters.
Through effective litigation and dispute resolution strategies, we strive to protect our clients’ interests and achieve favorable outcomes in complex fiduciary litigation and tax controversy matters.
