Kaye Scholer and the Directors Roundtable co-sponsored a world conference on the ”Global Reach of U.S. & Chinese Regulation & Enforcement.” Litigation partner Peter Haveles and antitrust chair Saul Morgenstern joined other distinguished speakers to discuss how the US and Chinese governments are increasingly extending their respective regulations and enforcement efforts globally.
Noting that the two nations have exercised control not only over their own companies, but also those from other countries—some companies have had deals blocked or paid multimillion and even billion dollar fines—the conference addressed securities and antitrust issues, including:.
- Relevant laws and enforcement practices;
- Possible penalties, up to and including cutting off of foreign business activities in a country;
- The power to impose liability on directors and c-suites; and
- Ways to defend against this reach, including litigation and negotiating strategies, asserting local laws to block this action and insuring against this risk.
