Arnold & Porter co-managing partner Ellen Kaye Fleishhacker was quoted in an article series from Private Equity Law Report on an environmental, social, and governance (ESG) risk alert issued by the SEC’s Division of Examinations that details their recent examination findings related to fund manager ESG disclosures, policies, and programs. The two-part series discusses the regulatory context surrounding the risk alert, using the risk alert as guidance for anticipated SEC enforcement efforts, and provides advice on establishing effective ESG practices. Fleishhacker, who also co-heads the firm's investment management practice, comments on global ESG frameworks and best practices for defining ESG goals.
