Global Competition Review Quotes Former FTC Competition Director Debbie Feinstein on FTC’s Rejection of Bid to Void Gas Settlement

Debbie Feinstein, head of Arnold & Porter’s Global Antitrust group and former Director of the Bureau of Competition at the Federal Trade Commission (FTC), was quoted in the Global Competition Review article, “FTC rejects bid to void gas settlement,” which examined the agency’s decision to deny a request by Quantum Energy Partners and EQT to set aside a 2023 consent order tied to their $5.2 billion transaction.

Debbie noted that the FTC defended its use of Section 8 of the Clayton Act—prohibiting interlocking directorates—by also alleging a separate violation under Section 5 of the FTC Act.

“I don’t think Section 5 will be used often, but it’s a tool the commission has and I think in appropriate cases they may decide to use it,” she said.
